Terms & Conditions of Use

1. About the Platform
These Terms and Conditions (“Terms”) govern access to and use of the website, platform, and services provided by TravelPhotoMatch (“TravelPhotoMatch”, “we”, “us”, “our”) (the “Platform”).
By accessing or using the Platform, creating an account, submitting a request, or completing a booking, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
TravelPhotoMatch is an online marketplace that connects travelers (“Travelers”) with independent professional photographers (“Photographers”) for photography services in destinations worldwide. TravelPhotoMatch does not provide photography services directly and is not a photography agency. All photo sessions are performed by independent Photographers.
2. Eligibility & Accounts
You must be at least 18 years old to use the Platform.
You agree to:
- provide accurate and complete information
- keep your login credentials secure
- be responsible for all activity under your account
TravelPhotoMatch reserves the right to suspend or terminate accounts that violate these Terms or applicable laws.
3. User Roles
Travelers
Travelers may browse photographer profiles, send booking requests, and book photography sessions.
Photographers
Photographers operate as independent contractors, not employees, partners, or agents of TravelPhotoMatch. Photographers are solely responsible for:
- complying with local laws and regulations
- providing the photography service
- delivering the agreed photo gallery
4. Booking Process
- A Traveler submits a booking request
- The Photographer confirms availability
- The Traveler completes payment
- The booking is confirmed
No payment is collected until availability is confirmed.
TravelPhotoMatch does not guarantee the availability of any specific Photographer, date, time, or location.
5. Pricing & Payments
Pricing for photography sessions is set by TravelPhotoMatch based on destination, service type, and other commercial factors.
Payments are processed securely through third-party payment providers. TravelPhotoMatch collects the booking amount and releases a payout to the Photographer after successful delivery of the photo gallery, minus a platform commission.
Commission structures may vary depending on destination, service type, or other conditions and are disclosed to Photographers through their dashboard or individual agreement.
6. Photo Delivery
Photographers must deliver the final edited gallery within the timeframe stated in the booking details. Photo delivery is typically handled via an external gallery service or an approved delivery method.
Funds are released only after delivery is completed.
7. Cancellations & Refunds
Cancellations and refunds are governed by our Cancellation & Refund Policy , which forms an integral part of these Terms & Conditions.
Refund eligibility depends on factors including, but not limited to, the time of cancellation, booking status, and responsibility for the cancellation. Please review the Cancellation & Refund Policy carefully before completing a booking.
8. Photographer Cancellations
If a Photographer cancels a confirmed booking without valid reason, the Traveler may be entitled to a refund or alternative solution. The Photographer’s account may be reviewed, penalized, or suspended.
9. Delays, Weather & External Conditions
Travelers are responsible for arriving on time at the agreed meeting point. Delays due to traffic, weather conditions, public events, or other external factors may reduce the effective shooting time and the number of delivered photos.
Weather conditions do not automatically entitle the Traveler to a refund. Photographers may propose alternative locations or rescheduling when reasonable.
10. Reviews & Feedback
After completion of a booking, Travelers may leave a review. Reviews must be honest, respectful, and based on real experiences. TravelPhotoMatch reserves the right to remove reviews that violate community guidelines.
11. Intellectual Property
Photographs
Unless otherwise agreed, Photographers retain full copyright ownership. Travelers receive a non-exclusive license for personal use. Commercial use requires explicit permission from the Photographer.
Platform Content
All platform content, branding, software, and design elements are the property of TravelPhotoMatch and may not be copied or reused without permission.
12. Use of Images for Promotion
Travelers grant TravelPhotoMatch and the Photographer a non-exclusive, royalty-free license to use selected images for promotional and marketing purposes. Travelers may request exclusion from promotional use by contacting support prior to delivery.
13. Limitation of Liability
TravelPhotoMatch is not liable for acts or omissions of Photographers, travel disruptions, weather conditions, or accidents, injuries, or damages occurring during a photo session.
To the maximum extent permitted by law, TravelPhotoMatch’s total liability is limited to the amount paid for the booking.
14. Indemnification
You agree to indemnify and hold harmless TravelPhotoMatch from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your interaction with Photographers or third parties.
15. Privacy & Data Protection
Personal data is processed in accordance with our Privacy Policy and applicable data protection laws, including GDPR.
Use of the Platform is also governed by our Privacy Policy, Cookie Policy, and Cancellation & Refund Policy, which form an integral part of these Terms & Conditions.
16. Account Termination
Users may request account deletion at any time. TravelPhotoMatch may suspend or terminate accounts that violate these Terms or applicable laws.
17. Changes to These Terms
TravelPhotoMatch may update these Terms from time to time. Updated Terms apply to future use of the Platform and new bookings. Continued use of the Platform constitutes acceptance of the updated Terms.
18. Governing Law & Jurisdiction
These Terms are governed by the laws of Italy. Any disputes shall be subject to the exclusive jurisdiction of the Italian courts.
